These terms govern your use of this website and any inquiry you make through it.

1. About these terms

This website is operated under the name Thinking Masheens (“Thinking Masheens”, “we”, “us” or “our”) from Noida | Delhi NCR, India. By accessing or using this website, you agree to these Terms of Service. If you do not agree, please do not use the website.

You must be legally capable of entering into a binding agreement. If you use the website for an organisation, you confirm that you are authorised to act for it.

2. Website information and inquiries

The website describes our capabilities in AI automation, software development, product design and related consulting. Its content is general information and is not legal, financial, employment, cybersecurity or other regulated professional advice.

Submitting or preparing an inquiry does not create a client, advisory, fiduciary, partnership, employment or agency relationship. We may accept or decline any inquiry. Do not send confidential, regulated or highly sensitive information before we have agreed in writing how it will be handled.

3. Consulting engagements

Any paid service, deliverable, timetable, fee, support commitment, intellectual-property transfer, data-processing obligation or service level must be set out in a separate written proposal, statement of work or agreement signed or otherwise expressly accepted by both parties. If that project agreement conflicts with these website terms, the project agreement controls for that engagement.

Estimates, demonstrations, prototypes and proof-of-concept results are exploratory unless a project agreement says otherwise. They do not guarantee production performance, commercial results, cost savings, revenue, regulatory compliance or uninterrupted operation.

4. AI systems and human oversight

AI systems can produce inaccurate, incomplete, biased, unexpected or non-unique outputs. Their behaviour and availability can change when models, data, prompts or third-party services change. You remain responsible for reviewing outputs and deciding whether they are suitable for your purpose before relying on, publishing or acting on them.

Unless expressly agreed in writing, our work is not designed for autonomous use in medical care, legal decisions, credit, insurance, employment, critical infrastructure, safety systems or other high-impact decisions. Appropriate human review, access controls, testing, monitoring and fallback procedures must be maintained.

5. Your responsibilities

You are responsible for the accuracy and lawfulness of materials, data, instructions, accounts and system access you provide. You confirm that you have the rights, permissions and lawful basis needed for us and approved service providers to use them for the agreed work.

You must not use this website or our materials to violate law or third-party rights; introduce malicious code; bypass security; probe systems without permission; impersonate others; generate unlawful, deceptive or infringing material; or make decisions about individuals in a way that is prohibited by applicable law.

6. Intellectual property

The website, brand, visual system, text, graphics, code and other site content are owned by or licensed to Thinking Masheens and are protected by applicable intellectual-property laws. We give you a limited, revocable, non-exclusive right to access the website for legitimate business evaluation. You may not copy, sell, redistribute, scrape, reverse engineer or create derivative works from site content except as law permits or we approve in writing.

Ownership and permitted use of client inputs, project deliverables, reusable tools, third-party components and AI-generated material will be defined in the applicable project agreement. Third-party materials remain subject to their own licences and terms.

7. Third-party services

Our website and consulting work may rely on hosting providers, AI model providers, cloud platforms, APIs and other third-party services. Their terms, availability, security and output policies are outside our control. A link or integration does not mean we endorse every feature or statement of that provider. You are responsible for any third-party account you choose to operate and its charges unless agreed otherwise.

8. Confidentiality and security

Website communications are not automatically covered by a professional duty of confidentiality. Any project confidentiality obligations must be recorded in writing. We take reasonable measures appropriate to our operations, but no website, email, model or network is completely secure. You should use approved secure channels for credentials, personal data, source code and sensitive business information.

9. Disclaimers

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available”. We do not promise that the website will always be available, secure, error-free or suitable for a particular purpose, or that its content will remain current. We disclaim implied warranties to the extent the law allows.

Nothing in these terms excludes a right or liability that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, Thinking Masheens will not be liable for indirect, incidental, special, exemplary or consequential loss arising from use of this website, including loss of profit, opportunity, goodwill, data or business interruption. Our aggregate liability arising solely from use of this free website will not exceed INR 5,000.

Liability connected with a paid engagement will be governed by its project agreement. These limits do not apply where liability cannot be limited under applicable law.

11. Indemnity

To the extent permitted by law, you agree to reimburse Thinking Masheens for third-party claims, losses and reasonable costs caused by your unlawful misuse of the website, your infringement of third-party rights, or materials you submit without the necessary rights or permissions. This does not apply to the extent a claim was caused by our own breach or misconduct.

12. Changes and availability

We may change, suspend or withdraw website content and may update these terms. Material changes apply prospectively when posted, unless law requires otherwise. Continued use after an update means you accept the revised website terms.

13. Governing law and disputes

These terms are governed by the laws of India. Courts with competent jurisdiction in New Delhi, India will have exclusive jurisdiction over disputes arising solely from the website, subject to any mandatory law. A separate project agreement may establish a different dispute process for consulting work.

14. General

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not transfer these terms without our written consent. These terms and the Privacy Policy are the entire agreement concerning use of this website.
